Conditions of Use

HR Metrics Center provides information and services on the hrmetricscenter.com website.  Some information and services are provided free of charge and some services are provided based on a paid subscription basis. By accessing, using, or downloading subscription or non-subscription materials from hrmetricscenter.com, you agree to accept these terms and conditions. The following terms and conditions of use apply to the entire hrmetricscenter.com website. If you do not agree with these terms, you may not use this website.

Online Metric Tools and Surveys

The HR Metrics Center provides on-line tools to help member organizations create human resource metrics. Members using these tools agree to provide accurate information regarding their organization and understand that by building metrics they are agreeing to participate in the HR Metric Center's on-line survey.

The primary source of data for survey results on the site is from members. When members build an HR metric their calculated metrics are aggregagated with other organizations to create benchmarks. Metrics from individual organizations are never revealed. At times the HR Metrics Center supplements member data with other studies to help ensure valid HR benchmarking results.

Membership

Basic membership in the site is free and provides access to MetricsPro, an on-line tool to develop and report on human resource metrics. An annual "Star" membership level is available after paying a service fee. Star membership provides access to ScorecardPro and BenchmarkPro, advanced tools for managing metrics and comparing metrics to the HR Metrics Center's survey results. Star membership lasts a period of one year and members will be given the opportunity to extend their membership after one year or may allow it to expire. Under no circumstances are refunds granted even if a member no longer utilizes the site during the one year Star membership.

Privacy Notice

HRMC, a Limited Liability Corporation, and hrmetricscenter.com pledges to protect the privacy of our members by adhering to the practices outlined in our privacy policy. Please carefully review our privacy policy for more information.

Ownership & Restrictions on Use

The HR Metrics Center contains proprietary material that is protected by U.S. and international copyright and other related laws. All content on hrmetricscenter.com including but not limited to products, information, documents, text, logos, graphics, applications, and software, is the property of The HR Metrics Center or its respective third party manufacturers, developers, authors, or vendors.

By using the HR Metrics Center benchmarking results and reports members agree as follows:
a. The HR Metrics Center operated by HRMC LLC is the exclusive copyright owner of the benchmark results and reports;
b. Members at a "Star" membership level have the right to use the benchmark results solely for the internal purposes of their organization or for the internal purposes of a single client of the organization. This includes the right to distribute copies of the benchmarking results to other employees within the member or organization or the within the organization of the single client;
c. The member organization or the single client organization or their employees may not sell, sublicense, loan, or otherwise convey or distribute the benchmark results or any copies thereof in any media to any third parties outside of the member organization or single client organization.

Site users are permitted the limited right to download and print The HR Metrics Center marketing, demo, reports and related advertising materials for non-commercial and informational use. Any other reproduction, except as permitted within the normal utilization of the site, without prior written consent is prohibited.

Written consent may be obtained by contacting: support@hrmetricscenter.com. Please include the specific source of material you would like to use, including paragraph and section if applicable, reasons for use, and intended use, including number of intended users.

Disclaimers of Warranties and Limitation of Liability

The HR Metrics Center materials and services are designed to provide accurate and authoritative information with regard to the subject matter covered. In producing these services and materials, The HR Metrics Center is not engaged in rendering legal or other professional services. If legal advice or other expert assistance is required, the services of a competent professional should be sought.

The HR Metrics Center uses care in publishing materials and makes every attempt to provide accurate information. However, we cannot guarantee their accuracy or completeness. Errors and omissions may occur. The HR Metrics Center will make reasonable efforts to correct any errors or omissions but makes no representation regarding the accuracy of information provided.

The HR Metrics center is not responsible for any loss or damage resulting from use of this site or unavailability of hrmetricscenter.com or any third party websites or content directly or indirectly linked through this website.  While we always strive to protect website visitors, we do not warrant that the website, its servers or emails are free of viruses or other harmful elements.

Some States do not allow limitations on implied warranties or exclusion or limitation of certain damages.  If these laws apply, some of limitations or exclusions above may not be applicable.

Customer Responsibilities

The HR Metrics Center relies on customers providing accurate information for customer benchmarking purposes.  By using this site customers agree to provide accurate data regarding their organization to the best of their knowledge and ability. In addition customers must be of legal age to enter into a binding contract and agree not to impersonate any person or entity.

Customers and users of The HR Metrics Center's services, products, materials, and site are solely responsible for the protection of and backup of data and equipment. The HR Metrics Center is not responsible for lost data, work delays, lost profits, inaccurate information, or other losses resulting from use of this site. You agree to hold The HR Metrics Center harmless from, and you agree not to sue The HR Metrics Center for any claims related to the use of this web site.

Applicable Law

By visiting and using hrmetricscenter.com, you agree that the laws of the State of Ohio, without regard to principles of conflict of laws, govern the Terms and Use of this website as well as any dispute that may arise between you and The HR Metrics Center.

Entire Agreement & Severability

These Terms and Conditions incorporate by reference any notices contained on this site and also constitute the entire agreement regarding access and use of this site. If any provision of these Terms and Conditions is found to be invalid, void, or unenforceable then that portion shall be severed, and shall not affect the validity and enforceability of the remaining provisions.

Mediation and Arbitration

If a dispute arises out of or relates to these Terms and Conditions, or the breach thereof, and the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Rules. Any controversy or claim arising out of or relating to this Agreement, or its breach, that is not resolved through mediation shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

Changes to Terms and Conditions

The HR Metrics Center's Site, as well as the Terms and Conditions of Use may be altered at any time, with or without notice. Please visit the Site often to review changes made.
